1. General

These Terms & Conditions apply to all purchases and registrations made through Anuttara, including online courses, programs, teacher trainings, live events, and in-person retreats. By completing a purchase or registering for an offering, you agree to be bound by these terms, which form a legally binding contract between you and Anuttara. If you do not agree to these terms, please do not purchase or register.

You must be at least 18 years old to purchase or register for any offering.

2. Services Description

Anuttara endeavors to describe and display its offerings as accurately as possible. Slight variations in content, format, schedule, presenters, or accessibility may occur. If an offering differs materially from its description, your remedy is a modification or a credit toward future offerings, to the extent permitted by law.

3. Pricing and Payment

All prices are in United States dollars (USD) unless otherwise indicated. Prices exclude applicable taxes, which are added at checkout where required. Anuttara may change prices at any time. Changes apply to future purchases and do not affect purchases already completed.

Full payment must be received before access to an offering is provided, unless you have registered for a payment plan. Payments can be made by credit card, PayPal, or other payment methods shown at checkout.

Payment plans: If you register using a payment plan, you agree to complete all scheduled payments. Failure to make a scheduled payment may result in suspension of access until the balance is current, and Anuttara may pursue outstanding amounts.

Payment disputes: If you have a concern about a charge, please contact us before filing a dispute with your bank or card provider so we can resolve it directly.

4. Cancellation and Refunds

Online courses, programs, and trainings:

- Within 7 days of purchase, and before you have received access to the course materials or the first live session has taken place, you may cancel for a full refund.
- After 7 days, and before access has been provided or the first live session has taken place, you may cancel for a refund minus an administrative fee of $150 USD.
- Once you have received access to the materials or the first live session has taken place, refunds are not provided. You may be eligible to transfer your enrolment to another session or an offering of equivalent value, subject to availability and prior approval.

In-person retreats and events:

Cancellation and refund terms for retreats and events may differ by event and are provided in the registration documents for that event. Please review them before registering. If they conflict with these terms, the event-specific terms apply.

Anuttara is not responsible for travel costs, delays, cancellations, or circumstances beyond our control, including natural disasters, strikes, pandemics, or government restrictions. In those cases, refunds may not be available, though credit or transfer options may be offered.

Scholarships and reduced-rate options:

Scholarship and reduced-rate places are non-transferable and may carry different cancellation or refund terms, which are communicated at the time of registration.

5. Recordings and Publication Agreement

Some live components may be recorded. By attending these sessions, you acknowledge and agree that:

- Recordings may be published, sold, archived, or otherwise used as Anuttara considers appropriate.
- Your likeness, voice, or participation may appear in these recordings.
- Recordings may be used for educational purposes, promotional materials, or community archives.

By attending, you grant permission for this use without compensation or additional approval. If you prefer not to appear in a recording, you may keep your camera and microphone off, or contact us before the session to discuss options.

6. Intellectual Property and Account Access

All materials provided as part of our offerings, including videos, documents, audio recordings, and other content, are the intellectual property of Anuttara. Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the materials for your own personal, non-commercial study.

You may not copy, record, reproduce, distribute, resell, teach from, or use the materials for commercial purposes, or use them to train artificial intelligence systems, without written permission from Anuttara.

Your account and access are for you alone. Sharing your login or access with others may result in suspension or termination of access without refund.

7. User Conduct

Participants are expected to be respectful and non-disruptive during all sessions. Anuttara reserves the right to remove any participant from an offering without a refund if their behavior is deemed inappropriate, disruptive, or offensive.

Retreats and in-person events: Participants are expected to contribute to a safe and supportive environment. Substance abuse, harassment, or disregard for retreat guidelines may result in removal without refund.

8. Nature of Our Offerings, Health, and Responsibility

Anuttara's offerings are educational and spiritual in nature. They are not medical, psychological, or psychotherapeutic treatment or advice, and they do not replace care from a qualified professional. Anuttara does not guarantee any specific result from participation.

Participation may involve physical, emotional, or spiritual practices, and these may bring up strong sensations or emotions. By registering, you affirm that you are responsible for your own health and well-being and that you participate at your own discretion. Please consult your healthcare provider before beginning any new practice if you have health concerns. If you are in crisis, contact your local emergency services or a crisis line in your area.

To the extent permitted by law, you release Anuttara from liability for injuries, conditions, or damages that may arise through your participation.

9. Privacy

Anuttara is committed to protecting your personal information. We collect, store, and use your data in accordance with our privacy policy, which is available on our website. Please review it to understand how we handle your personal details.

10. Communications

By registering or purchasing, you agree that Anuttara may email you about your enrolment, including access details, receipts, and updates about your offering. Marketing emails include an unsubscribe link, and you may opt out of them at any time.

11. Text Message Reminders

By providing your mobile number and opting in, you agree to receive text messages from Anuttara about the specific events you have registered for, including the Heart of Tantra Yoga series. Messages are limited to reminders of when an event is happening and updates about that event, such as schedule changes.

Consent: You opt in when you register for an event by checking the text message opt-in box. Opting in is optional and is not a condition of any purchase. Consent can be withdrawn at any time.

Message frequency: Message frequency varies based on the events you register for. You will receive messages only about those events.

Costs: Message and data rates may apply, according to your mobile plan.

Opting out: Reply STOP at any time to unsubscribe. You will receive a confirmation text and no further messages. Reply START to resubscribe.

Carriers: Mobile carriers are not liable for delayed or undelivered messages.

Privacy: We do not sell, rent, or share mobile phone numbers or text message opt-in data with third parties or affiliates for their marketing or promotional purposes. Your information is handled in accordance with our privacy policy.

12. Limitation of Liability

To the extent permitted by law, Anuttara is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of, or inability to use, our offerings, including damages for loss of profits, data, or other intangible losses. Anuttara's total liability for any claim is limited to the amount you paid for the offering that is the subject of the claim.

13. Changes to These Terms

Anuttara may update these terms from time to time. Updates are posted on this page with a new effective date. Your purchase is governed by the terms in effect at the time you purchased.

14. Governing Law and General

These terms are governed by the laws of British Columbia, Canada, and any disputes will be resolved in the courts of British Columbia. If any part of these terms is found unenforceable, the remaining parts stay in effect. These terms are the entire agreement between you and Anuttara regarding your purchase.
